Surprisingly, a US district judge recently issued a temporary restraining order blocking former Binance CEO Changpeng Zhao’s plans, preventing him from returning to the United Arab Emirates (UAE) until he is sentenced in February 2024. .

This legal development comes as Zhao previously pleaded guilty to charges related to anti-money laundering violations, which placed him in the crosshairs of the US legal system. Judge Richard Jones of the U.S. District Court for the Western District of Washington in Seattle issued an order on Nov. 27 making clear that Mr. Zhao must remain in the United States until the court processes the government’s motion for reconsideration.

The plot thickened as federal prosecutors alleged that Zhao, often referred to as CZ, was a flight risk due to his significant assets and strong ties to the UAE. They argue this could potentially allow him to slip through the cracks of U.S. jurisdiction, a concern exacerbated by the absence of an extradition treaty between the U.S. and the UAE. In an effort to mitigate this perceived risk, prosecutors are pushing for Mr. Zhao to remain in the United States rather than face prison.

This legal story takes an interesting turn, as the latest ruling contradicts an earlier decision by a magistrate court judge that allowed Zhao to return to the UAE as part of his bond conditions. The government’s concerns are rooted in the possibility that Zhao will not appear for sentencing on February 23, 2024, as scheduled, and are further complicated by the lack of an extradition agreement.

To further complicate matters, in a settlement with the U.S. Department of Justice, Zhao agreed to resign from his position and personally pay a hefty fine of $50 million. Meanwhile, Binance, the cryptocurrency exchange he led, is expected to pay a huge fine of $4.3 billion. The resolution follows Zhao’s direct guilty plea to violating the Bank Secrecy Act. Despite the seriousness of the charges, CZ was released on a $175 million personal recognizance bond, leaving the financial and legal communities speculating about the complex consequences that could unfold.
